In particular, the Company recognises that effective and honest communication is essential if concerns about breaches or failures are to be effectively dealt with and the Company\u2019s success ensured.\u00a0<\/p><p>This policy is designed to provide guidance to all those who work with or within the Company who may from time to time feel that they need to raise certain issues relating to the business with someone in confidence.<\/p><p>Employees who in the public interest raise genuine concerns under this policy will not under any circumstances be subjected to any form of detriment or disadvantage as a result of having raised their concerns.<\/p><p><\/p><h3><strong>Procedure<\/strong><\/h3><p>This policy will apply in cases where employees genuinely believe that one of the following sets of circumstances is occurring, has occurred or may occur within the Company that:<\/p><ul><li><p>A criminal offence has been committed, is being committed or is likely to be committed;<\/p><\/li><li><p>A person has failed, is failing or is likely to fail to comply with any legal obligation to which he or she is subject<\/p><\/li><li><p>A miscarriage of justice has occurred, is occurring or is likely to occur;<\/p><\/li><li><p>The health and safety of any individual has been, is being or is likely to be endangered;<\/p><\/li><li><p>The environment has been, is being or is likely to be damaged<\/p><\/li><li><p>Information tending to show any matter falling within any one of the preceding paragraphs has been, is being or is likely to be deliberately concealed.<\/p><p><\/p><\/li><\/ul><p>There is no need for an employee to prove that the breach or failure that they are alleging has occurred or is likely to occur; a reasonable suspicion will suffice, i.e. where the employee reasonably believes that the information disclosed is substantially true. Employees should, however, note that they are not entitled to make a disclosure if in so doing they commit a criminal offence.<\/p><p>If employees wish to raise or discuss any issues which might fall into one of the above categories listed, they should raise their concerns to the person they report to or, a director. This person will, insofar as is possible, treat the matter in confidence. It is likely that an investigation will be necessary and the employee who has made the disclosure may be required to attend an investigatory hearing and\/or a disciplinary hearing (as a witness). Appropriate steps will be taken to ensure that the employee's working relationships are not prejudiced by the fact of the disclosure.<\/p><p>If an employee feels that despite the best efforts of the Company the disclosure is inappropriate or has been unsuccessful, employees may then contact Public Concern at Work (<a target=\"_blank\" href=\"http:\/\/www.pcaw.org.uk\" rel=\"noreferrer noopener\">www.pcaw.org.uk<\/a>), which is the leading authority on public interest whistleblowing.<\/p><p>Employees should be aware that the policy will apply where they reasonably believe that the information disclosed and any allegations contained in it are substantially true. If any disclosure is made in bad faith (for instance, in order to cause disruption within the business), or concerns information which employees do not substantially believe is true, or indeed if the disclosure is made for personal gain, then such a disclosure will constitute a disciplinary offence for the purposes of the Company\u2019s disciplinary policy and procedures and may constitute gross misconduct for which summary dismissal is the sanction.\u00a0 Each case will be treated on its own facts.<\/p><p>An employee who makes a disclosure is protected from detrimental treatment by the Company and their co-workers.\u00a0 If this occurs, it should be raised immediately with your Line Manager so that the matter can be investigated thoroughly.\u00a0 Staff are also protected from dismissal by the Company for making a protected disclosure.<\/p>"},"borderRadius":{"id":104595058,"value":"#{text.border.radius}"},"textColor":{"id":104595059,"value":"#{text.color}"},"backgroundColour":{"id":104595060,"value":"#0000"},"truncateHeight":{"id":104595061,"value":null},"template":{"id":104595062,"value":"text"},"padding":{"id":104595063,"value":"6"},"fullWidth":{"id":104595064,"value":"0"},"fullBackgroundColor":{"id":104595065,"value":"#{text.fullBackground.color}"},"published":{"id":104595066,"value":"1"},"conditions":{"id":104595067,"value":"[]"}}}],"properties":{"title":{"id":104594800,"value":"Whistleblowing"},"isStorePage":{"id":104594801,"value":"1"},"ogImage":{"id":104594802,"value":"https:\/\/images.podos.io\/853quu91z1pbdpvsiphzsbwbyuou4wsagaocidnugtdye4zc.jpeg.jpg?w=1200&h=auto"}},"labels":[],"published":1,"sitemap":1,"divisionId":388371,"edited":true,"keyPhraseCampaignId":null}
